A plea bargain (also plea agreement, plea deal or copping a plea) is an agreement in a criminal case whereby the prosecutor offers the defendant the opportunity to plead guilty, usually to a lesser charge or to the original criminal charge with a recommendation of a lighter than the maximum sentence.

A plea bargain allows criminal defendants to avoid the risk of conviction at trial on the original more serious charge. For example, a criminal defendant charged with a felony theft charge, the conviction of which would require imprisonment in state prison, may be offered the opportunity to plead guilty to a misdemeanor theft charge, which may not carry jail time.

In cases such as an automobile collision when there is a potential for civil liability against the defendant, the defendant may agree to plead no contest or "guilty with a civil reservation", which essentially is a guilty plea without admitting civil liability.

Plea bargaining can present a dilemma to defense attorneys, in that they must choose between vigorously seeking a good deal for their present client, or maintaining a good relationship with the prosecutor, for the sake of helping future clients.

Serious inquiry: is atty name often followed by a caption (ex):"of the law firm of' You, Who, & Meetoo' LLP."
Q. in the opening paragragh of a pleading? Isn't it usually confined to following signature?( It appears again there as well) I appreciate any input, ...how often, & why you think this is relevant to include?- ex:(Comes now, Pammy Mammy, by & through her atty, Sammy Slammy, of the law firm "Whammy, Jammy, & Slammy" LLP, and files this response...)-Thanks!

A. Yes, as often as you prepare a pleading and my guess is they include such information so the court is aware of who the attorney is as well who he works for.

Harassing phone calls from a "law firm"?
Q. Over a year ago I started receiving phone calls on my cell from a guy who is obviously foreign (he can barely speak English). This guy was calling a friend of mine, then began calling my parents as well. The phone calls stopped for about 6 months; now, here we go again! But this time, I am not only receiving the calls from this guy, but a woman too! There are several reasons I think these phone calls are not legit: 1) The callers barely speak English, yet they say their names are Mary, John, Frank, Jenny, etc. 2) Although the callers use different names, they sound like the same person to me 3) When the calls began, the guy was stating my SSN on my voice mail. He was saying something to the effect of, ". . . we have your your SSN as:… [cont.]

A. If you have a record of their phone numbers, contact the Supreme Court of the State in which the area code resides, specifically the disciplinary committee. Their behavior could be a violation of the rules of professional ethics for attorneys. It is also a violation of law to claim you are a law firm when in fact you are not. If they are attempting to collect a debt, they could be violating the Fair Debt Collection Practice Act. Also, contact your state's attorney general office and get on the do not call list. When you verified that you are on there, contact them when you get another call, then sue them for the violation. The penalty of several thousand dollars is worth it to an attorney to help you collect. The phone company can help you… [cont.]
